I. Actual language negotiated by Local 1547, Luke AFB

      1. Trading “Time” or “Kelly Days” among Unit firefighters is permissible, provided

          that the following conditions are met:

a. Time and Kelly Day trading is done on a volunteer basis.

b. Employees who trade must be proficient in the position of the person with whom they are trading [Firefighter Certifications equivalency].

c. The reason[s] for trading is for personal reasons and will not be used to fulfill needs of the Employer.

d. All time trading will be recorded in the station logbook kept in the alarm center.

e. The exchange will not result in the increase or decrease of entitlement to overtime compensation for either employee involved.

f. Pay back of time traded will be completed between the two individuals prior to the start of the next pay period, following the completion of the time-trade.

g. Requests to trade time or Kelly Days will be made to each respective Assistant Chief at least [1] shift prior to the date of the exchange.

h. The appropriate Crew Captains and Station Captains will be notified prior making the exchange.

i. The request will specify the names, date[s] and time[s] being traded. Disapproval of trade requests will be based on adverse impact to the flying mission or other management requirement, which must be supported with facts.

j. Time and Kelly Day trading is voluntary and if a trade or proposed trade results in disagreement concerning the terms of such a trade, the employees involved must resolve the disagreement between themselves. Neither employee ought to loose any time or leave.

k. Each Assistant Chief of operations will ensure that all agreements are complied with and disagreements are settled appropriately.

l. Trading and restoration of time traded is an issue between employees. The employer shall not in any way, be held liable to compensate employees for any hours worked beyond the normally scheduled hours of work for each employee.

m. Employees who abuse this privilege may be charged leave without pay. Lose of these privileges may occur when abuse or misuse is determined by the appropriate supervisor. The Union will be notified in writing prior to the removal of any privileges.

II. Actual language negotiated by Local 1603, PaxRiver NAS

1. Trade Time Provisions:


a. The trading of time is done voluntarily by employees participating in the program and not at the request of management.

b. The reason for trading of time is to attend to personal matters.

c. The written agreement between the two (2) employees trading time shall be signed by both employees and by both Shift Assistant Fire Chief’s (only 1 if trade is between employees of the same shift). This approval will normally be obtained at least 24 hours prior to the time they wish to make a trade. Exceptions will be granted for emergency situations.

d. Employees coming or departing to and from duty for trading of time will check in and / or out with the on-duty station supervisor.

a. The Assistant Fire Chiefs shall maintain a record of all trading of time.

b. The minimum time traded will be one (1) hour and the maximum will be twenty-four (24) per event.

c. An employee will not be paid additional overtime pay during a trade time period.

d. Traded time will normally be paid back within thirty (30) days from the first trade day.

e. Failure to “pay-back” traded time places no obligation on the management for enforcement or compensation. This process will be self-policing.

III. Language proposed by Local 1770, Fort Bragg:

F. Trading of Regular Scheduled Days Off. (Kelly Days). Employees assigned to the same shift may exchange one regular scheduled 24-hour tour of duty for a regular scheduled day off upon submission of a written request and with the approval of the appropriate on-duty supervisor. Exchange must be made by mutual agreement between the employees concerned. Such exchanges shall not result in either working more or less than his/her total scheduled tour of duty during a pay period, or create a situation in which one or both employees would be entitled to additional compensation of any kind.
